FFCRA questions and answers

Q: What are the effective dates for the paid leave provisions?

A: Time taken between April 1, 2020 and December 31, 2020

Q: Are there any limits on the hours?

Q: Can time be applied for days already taken?

A: The paid sick leave and expanded family medical leave time are NOT retroactive and can only be used to cover time that would have started on April 1 through December 31, 2020.

Q: What if employees are not working because the employers are closed either due to lack of business or state / local order?

A: In these scenarios, employers do not have to provide the leave.

Q: What about furloughed employees?

A: Employees who are furloughed (not working but still on payroll) are not entitled to the benefits.

Q: Who is eligible for unemployment?

A: Eligibility for unemployment compensation is determined by the state unemployment office.

Q: Do employees have to wait to claim unemployment benefits?

A: Employees can file for unemployment as soon as no work available.  For questions regarding unemployment, refer to https://www.dol.gov/general/topic/unemployment-insurance

 

Q: What will happen to my unemployment rate if an employee files for unemployment?

A:  Refer to your state’s unemployment office.

Q: What is better for my company an SBA loan or applying for a PPP loan or both?

A: The answer is dependent on your situation as some loan options may be forgiven. Consult with your accountant or tax advisor.
